Statistical declaration is provided for the control of the transportation of goods through the territory of the countries that are part of the Customs Union. If you export or import goods to the territory of the Russian Federation or beyond and have an agreement with representatives of the EAEU, you must submit to customs a document recording the movement of goods with the data specified in it on the amounts of turnover. The declaration is submitted to the customs authorities within the time limits approved by law, and delays entail administrative fines.

At the same time, statistical declaration is not the same as customs clearance. The cargo is transported directly to your warehouses without lingering in the control area.

Thus, Decree No. 182, which amended Decree No. 178 of the President of the Republic of Belarus dated 03/27/2008 “On the Procedure for Conducting and Controlling Foreign Trade Operations” (hereinafter — Decree No. 178), provides for simplification of the procedure for submitting statistical declarations in the form of an electronic document by residents of the Republic of Belarus, namely the transition to:
— the application of one document — the article of the statistical declaration (instead of two — the statistical and periodic statistical declaration);

an increase of up to 3,000 euros in the total cost of goods shipped (delivered) in the reporting calendar month within the framework of a foreign trade agreement, in respect of which the submission of a statistical declaration is mandatory.

Resolution No. 533, in particular, establishes:

the deadline for submitting a statistical declaration for registration is from the 1st to the 10th day of the month following the reporting one or more facts of shipments (deliveries) of goods, the total value of which is the equivalent of 3,000 euros or more, for the reporting calendar month under a foreign trade agreement providing for the paid transfer of goods;

the deadline for making changes to the registered statistical declaration is within three years from the date of its registration in the cases listed in subparagraph 1.8 of paragraph 1 of Resolution No. 533;

the deadline for cancellation of a registered statistical declaration is no later than 20 calendar days after the date of its registration, if there are grounds listed in subparagraph 1.9 of paragraph 1 of Resolution No. 533.

At the same time, the submission and registration of the statistical declaration is carried out around the clock.

In order to make changes to a registered statistical declaration or to cancel a registered statistical declaration, a corrective (canceling) statistical declaration may be submitted on any day of the calendar month.

Please note that in accordance with paragraph 2 of Resolution No. 533, in respect of goods, the shipment (delivery) of which took place before October 3, 2020 inclusive, the submission, filling in, registration of a statistical and periodic statistical declaration, amendments to the registered statistical and periodic statistical declaration, their cancellation are carried out in the cases and in the manner specified by the acts legislation on statistical declaration issues in force on the day of shipment (delivery) of such goods.

Resolution No. 533 comes into force in the following order:

Items 1-4 – from October 4, 2020;

other provisions of this resolution – after its official publication.

Based on the paragraph of the third subparagraph 1.1, subparagraphs 1.4 and 1.5 of paragraph 1 of Resolution No. 533, Resolution No. 19 of the State Customs Committee of the Republic of Belarus dated September 18, 2020 “On Amending Resolution No. 2 of the State Customs Committee of the Republic of Belarus dated January 26, 2012” was adopted.

Based on the paragraph of the third subparagraph 1.1 of paragraph 1 of Resolution No. 533, Resolution No. 20 of the State Customs Committee of the Republic of Belarus dated September 18, 2020 “On determining the structure and format of the statistical declaration in the form of an electronic document” was adopted.

The deadlines for submitting a statistical declaration on one or more facts of shipments (deliveries) of goods carried out since October 4, 2020, the total cost of which is the equivalent of 3,000 euros or more for the reporting calendar month under a foreign trade agreement providing for the return transfer of goods, are determined by part one of subparagraph 1.2 of paragraph 1 of Resolution No. 533 – c 1st to 10th of the month following the reporting one (from November 1st to November 10th).

In accordance with the second part of subparagraph 1.2 of paragraph 1 of Resolution No. 533, at the discretion of the exporter (importer), the shipper (consignee), a statistical declaration may be submitted in respect of shipments (receipts) of goods whose total value is equivalent to less than 3,000 euros.

The obligation for a resident to provide a statistical declaration on one or more facts of shipments (deliveries) of goods, the total value of which is the equivalent of 3,000 euros or more, for the reporting calendar month within the framework of a foreign trade agreement providing for the return transfer of goods, is established by subparagraph 1.16.1 of paragraph 1 of Decree of the President of the Republic of Belarus dated March 27, 2008 No. 178 “On the procedure conducting and controlling foreign trade operations” (as amended by Decree of the President of the Republic of Belarus dated June 1, 2020 No. 182 “On Amending the Decree of the President of the Republic of Belarus”).

Thus, the submission of a statistical declaration on deliveries for January as well as for February is not mandatory.

At the discretion of the exporter (importer), the shipper (consignee), a statistical declaration may be submitted in respect of shipments (receipts) of goods whose total value is equivalent to less than 3,000 euros.

The submission of a statistical declaration for the January delivery, the amount of which is 500 euros, is not a mandatory requirement.

At the discretion of the exporter (importer), the shipper (consignee), a statistical declaration may be submitted in respect of shipments (receipts) of goods whose total value is equivalent to less than 3,000 euros.

The submission of a statistical declaration regarding the delivery for February, the amount of which is 3,500 euros, is mandatory.

The deadlines for submitting a statistical declaration on one or more facts of shipments (deliveries) of goods carried out since October 4, 2020, the total cost of which is the equivalent of 3,000 euros or more for the reporting calendar month under a foreign trade agreement providing for the return transfer of goods, are determined by part one of subparagraph 1.2 of paragraph 1 of Resolution No. 533 – c 1st to 10th of the month following the reporting one (from November 1st to November 10th).

In accordance with the second part of subparagraph 1.2 of paragraph 1 of Resolution No. 533, at the discretion of the exporter (importer), the shipper (consignee), a statistical declaration may be submitted in respect of shipments (receipts) of goods whose total value is equivalent to less than 3,000 euros.

Which documents will need to be sent to the declarant:

• a purchase and sale agreement or a supply contract;
• If the total amount of the contract exceeds 3,000 euros, the transaction must be registered with the bank and a document confirming such registration must be submitted;
• Invoices for the goods;
• The invoice;
• Shipping invoices;
• Shipment certificate.
